§1 General

1. The following Terms of Use apply to all Users of services provided by xxxfreeweb.net.
2. The following terms in their relevant version also apply to future services and shipments, even if the orderer does not get a copy or a reference to the Terms of Use along with the ordered service or shipment again.
3. Different Terms and Conditions of our international contractual partners are not integral part of the contract.

§2 Services / Contract / Cancellation

1. Our service are free of charge.
2. A contract underlieing these Terms of Use is accomplished with the handout of a Service.
3. We reserve the right, at our own discretion, to shut down our free Service at any time without a claim for indemnity for the orderer or the webmaster. We also reserve the right to immediately exclude you from the Service without any warning if you violate these Terms of Use.

§3 Service Description

1. We offer a free webspace-account. Other services like email, telnet and so on are not included.
2. Advertisements will be displayed on each account to finance this service.
3. User support through email, telephone or other forms of communication and the offered services are based on voluntary work. There is no claim for providing any service.

§4 Rights and Duties of the Participant

1. The provided personal information of the participant has to be truthful. The Information will be saved, but not transmitted to third-parties, provided that there is no violation against the law.
2. The participant has to take care that no third-parties are accessing the participants account. In this context the participant has to make sure that nobody gets the password or other user-specific information.
3. The participant is not allowed to save only parts of a website at xxxfreeweb.net. The participant can link to .html/.php files on xxxfreeweb.net, but is not allowed to link to single objects/elements (like an image).
4. The participant has to abidance by the law when using the Service, particularly to copyrights and the terms for the protection of minors and the terms for using or providing software. A participant whose contents are illegal or harmful to young people, with respect to the country law, has to implement a valid protection for the minors.
5. The participant is liable for the proper use and the necessary care to not produce avoidable extra costs for xxxfreeweb.net.
6. The participant is not allowed to use/install any of the following contents/systems:
   • Counter-Systems
   • Bannerrotation-Systems
   • Chat-Systems
   • Downloadarchives

§5 Linking / Content

xxxfreeweb.net does not come with any possibility to control published content or links referencing other websites or sources. Content and links are produced by the user.

It is not possible for xxxfreeweb.net to check all content and links because of the big amount of users. If xxxfreeweb.net gets notice about illegal content or links to illegal content it will be deleted immediately and the user will be informed.

The user is liable to verify the content of external websites and maybe to get a permission before a link is integrated into the users website on xxxfreeweb.net.

Links to external websites have to be basically made recognizable by opening a discrete window for the contents of the external website.

There is no liability for traffic that is caused by links located on websites that we host.

§6 Warranty / Liability

Usage of services provided by xxxfreeweb.net is based on the users own risk.

There is no liability that the services of xxxfreeweb.net are available, timely or accurate

xxxfreeweb.net does not make any active backups. There is no liability for lost content, data or other information. The user is responsible for doing backups on his own.
